Supreme Court Clears Way for Parliamentary Inquiry Against Justice Yashwant Varma

The Supreme Court of India has declined to interfere in the ongoing parliamentary inquiry proceedings against Justice Yashwant Varma, delivering a significant setback to the judge and allowing the investigation process to continue.
Justice Varma had approached the apex court challenging the decision to form a parliamentary inquiry committee under the Judges (Inquiry) Act. He argued that the procedure adopted by Parliament was flawed and sought a stay on the panel’s functioning. However, the Supreme Court rejected the plea, stating that there was no legal ground to halt the constitutional process.
Court’s Observations
The bench observed that the Speaker’s decision to admit the motion and constitute an inquiry committee falls within the scope of parliamentary authority. The court emphasised that judicial intervention at this stage would be inappropriate, as the inquiry process itself is part of a constitutionally defined mechanism.
By dismissing the plea, the Supreme Court made it clear that the inquiry committee is free to proceed with examining the allegations and submit its findings to Parliament.
Background of the Case
The proceedings against Justice Varma stem from allegations related to the recovery of large sums of cash from his official residence during a fire incident last year. Justice Varma has denied any wrongdoing and has previously challenged internal inquiries related to the matter.
Following the submission of a removal motion by Members of Parliament, the Lok Sabha Speaker constituted a three-member inquiry committee to investigate the allegations.
What Happens Next
With the Supreme Court’s refusal to intervene, the parliamentary panel will continue its inquiry as per the law. Based on the committee’s report, Parliament may decide on further steps, including possible impeachment proceedings.
